Report on the work of military courts of the Donetsk People’s Republic as of May, 31, 2018

As of May 31, 2018, the Military Field Court of the Donetsk People's Republic has:

registered 77 criminal cases against 109 persons, including 78 held in custody, of which 2 criminal cases over compulsory measures of medical character against 2 persons held in custody. In 2018 there have been registered 25 criminal cases against 39 persons, of them against 23 held in custody.

23 criminal cases against 33 persons, of them 17 held in custody, have been already heard.

Upon the results of the consideration:

the Court delivered a judgement of conviction on 16 cases against 24 persons, of whom 14 in custody;

5 judgements of dismissal were delivered against 5 persons, including 1 held in custody;

2 criminal cases against 4 persons, including 2 held in custody, were sent for re-investigation.

As of May 31, 2018, remain unheard 54 criminal cases against 76 persons, of them 61 held in custody, including 2 cases on over compulsory measures of medical character against 2 persons held in custody.

Proceedings on 2 criminal cases against 2 persons were suspended due to putting the accused on the wanted list.

In 2018 the Military Field Court has also registered 4 criminal materials over change of measure of restraint against 7 persons, among which 3 materials against 6 persons were received in 2018.

2 criminal materials against 5 persons have been already heard.

As of May 31, 2018, remain unheard 2 criminal materials against 2 persons.

In 2018 the Military Tribunal as the Chamber of the Supreme Court of the Donetsk People’s Republic has:

Registered 53 criminal cases against 108 persons, of them 86 held in custody, including 19 cases against 24 persons received in 2018.

Heard 12 cases against 20 persons, among them 16 held in custody.

Upon the results of the consideration:

judgements were delivered on 8 cases against 11 persons held in custody;

judgements of dismissal were delivered on 2 cases against 2 persons;

one judgement on sending a case for re-investigation was delivered on 1 criminal case against 6 persons, including 4 held in custody;

one judgement on compulsory measures of medical character was delivered on 1criminal case against 1 person held in custody.

Remain unheard 41 cases against 88 persons, among whom 70 are held in custody.

Proceeding on 1 case against 2 persons was suspended due to putting the accused on the wanted list.

Consideration of petitions to change/ determine jurisdiction:

20 petitions (requests) with criminal cases on changing/ determining jurisdictions were registered.

19 petitions (requests) were heard. Upon their consideration there were delivered judgements on determining the jurisdiction of a criminal case, on transferring a case for consideration on the merits to another court.

Consideration of appeals against actions (omissions) by people holding an inquest, by inquiry bodies, investigators, heads of investigation departments, prosecutors; and appeals against orders to dismiss criminal complaint, to initiate and terminate a criminal case:

There were registered 7 appeals against actions (omissions) by people holding an inquest, by inquiry bodies, investigators, heads of investigation departments, prosecutors; and appeals against orders to dismiss criminal complaint, to initiate and terminate a criminal case.

6 appeals were considered, upon which:

5 appeals were left undecided;

1 appeal was dismissed;

1 appeal was not considered.
