According to operational statistics, during the period from January to May 2018, the Supreme Court of the Donetsk People's Republic has registered 1,324 civil cases and materials.
Of the stated number of cases, during the period from January 9, 2018 to May 31, 2018 the Supreme Court has already heard 1,080 civil cases and materials.
As of May 31, 2018, the reminder of the cases unheard constitutes 244 civil cases and materials.
In the first instance there were 4 civil cases, of them 2 have been heard with consequent render of a judgement.
Under cassational procedure there have been 951 cases, including 781 cases registered in 2018, of them 788 civil cases have been already heard.
The results of hearing of cases are as follows:
1) 29 cases were quashed;
2) 91 cases were sent back to courts, of them:
– 9 cases were sent for proper engrossment;
– 3 cases were sent because of withdrawal of cassational appeal;
– 78 cases were sent otherwise;
3) proceeding was closed on 1 case;
4) 667 cases were heard on cassational appeals, including:
– 460 cases on cassational appeals against court decisions;
– 207 cases against first instance court rulings.
The results of hearing of cases on cassational appeals against first instance court decisions are as follows:
– 145 decisions were upheld;
– 305 decisions were reversed, of them 302 decisions rendered by the courts of the Donetsk People’s Republic, including:
– 1 decision was partly reversed;
- 42 new decisions were rendered;
– 251 cases were sent for retrial;
– 3 proceedings were closed;
– 6 cases were dismissed without hearing;
– 2 cases were allowed by the Supreme Court on the first instance.
– 10 decisions rendered by the courts of the Donetsk People’s Republic were quashed.
The results of hearing of cases on cassational appeals against first instance court rulings are as follows:
– 73 court rulings were upheld;
– 129 court rulings were reversed, of them 127 rulings were brought by the courts of the Donetsk People’s Republic, including:
– 5 cases were resolved on the merits;
– 95 cases were sent for retrial;
– 21 cases were sent for further hearing;
– 1 case was dismissed without hearing;
– 1 proceeding was closed.
– 5 decisions rendered by the courts of the Donetsk People’s Republic were quashed
As of May 31, 2018 there remain unheard 163 civil cases, including 1 suspended proceeding.
In 2018, the Supreme Court allowed 123 supervisory complaints on civil cases.
Upon the results of hearing of complaints against court decisions:
– 15 appeals against court decisions on civil cases were brought;
– 68 submissions on court decisions on civil cases were made.
In 2018, in the Presidium of the Supreme Court of the Donetsk People’s Republic there were pending:
– 74 submissions on court decisions on civil cases, of which 60 have been heard;
– 175 appeals against court decisions, of which 144 have been heard.
On the brought appeals the Presidium of the Supreme Court has reviewed 166 judicial decisions on civil cases, of which 160 court decisions on civil cases were reversed, including 11 Supreme Court rulings.
1 submission on ruling and change of jurisdiction was heard, on the results of consideration of which a ruling was passed on transferring the case for consideration on the merits to another court.
The above statistics show the proper organization of work on the administration of justice in the Republic.
