According to operational statistics on the work of the Supreme Court of the Donetsk People's Republic in administering justice during the period from January to June 2018, the Arbitration Chamber of the Supreme Court of the Donetsk People's Republic has registered 418 cases under cassational procedure. At the same time, during the indicated period, the panel of judges has considered 370 arbitration cases, including: 93 cases returned to the Arbitration Court, 5 terminated cassational proceedings.
The Arbitration Chamber has heard 224 arbitration cases on cassational appeals against decisions of the courts of first instance. Upon the results of the consideration 179 decisions were left unchanged, 2 decisions were changed, 43 decisions were reversed, of which: new decisions were rendered on 14 cases, 29 cases were sent back for retrial.
The Arbitration Chamber has heard 48 arbitration cases on cassational appeals against judgements of the courts of the first instance. Upon the results of the consideration 42 judgements were left unchanged, 6 judgements were reversed, of which: 5 cases were sent back for retrial, 1 case was sent for further hearing.
Apart from this, during the specified period, there were heard 2 petitions for review of court decisions on new and newly discovered facts, including: 1 petition was returned, 1 petition was reviewed with leaving the judgement unchanged.
In January-June, 2018, in the supervisory instance of the Supreme Court of the Donetsk People's Republic, there were 120 pending appeals against court decisions on arbitration cases; of them decisions were rendered on 80 appeals, namely: 20 objections were filed, 60 judgements were made on dismissal of review of a court decision.
Apart from this, in January-June, 2018, there were 31 pending appeals against decisions on arbitration cases in the Presidium of the Supreme Court of the Donetsk People's Republic, of which: upon consideration of supervisory appeals – 20 cases, on the initiative of the Chairman of the Supreme Court of the Donetsk People's Republic – 11 cases. In total, over the stated period the Presidium of the Supreme Court has heard and satisfied 27 appeals. Upon the consideration of the appeals, 2 decisions on arbitration cases were changed and 43 decisions rendered by the courts of the Donetsk People's Republic were reversed.
